Jordan – Trademarks

 

From Filing to Registration: 10-12 Months

Convention Priority: Yes

Classification of Goods/Service: International (10th edition)

Multiple Class Applications: N/A

Procedure: Once the application is filed, it is queued to be examined as to trademark registrability. Accepted applications by the Registrar are published in the Official Gazette. There is 3 months period for filing an opposition by any interested party. In the absence of an opposition, the published trademark is registered, and the certificate of registration is issued.

Registration Validity: 10 years, renewable for other consecutive periods, each of which is 10 years.

Renewal Time: Application for Renewal should be submitted prior to expiry date. There is 12 months grace-period for late renewal without payment of a surcharge.

Trade/Service mark Use: Not pre-requisite for registration. However, a trademark is vulnerable for cancellation by any interested party, who may prove that the trademark was not actually used for three consecutive years.

Requirements:

Trademark/Service Mark Applications

1. Power of attorney duly notarized and legalized up to the Consulate of Jordan.
2. The name, nationality, address and occupation of the applicant.
3. Fifteen prints of the trademark for each class of goods.
4. Certified priority document, if priority to be claimed.

Renewal of Trademark/Service Mark Registrations

1. Power of attorney duly notarized and legalized up to the Consulate of Jordan.
2. Photo copy of the certificate or registration.

Assignment Applications

1. Power of Attorney by the assignee duly notarized and legalized up to the Consulate of Jordan.
2. Deed of Assignment, signed by both parties, notarized and legalized up to the Consulate of Jordan.
3. Name, address, nationality, and profession or nature of business of the assignee.

Change of Name Application

1. Power of Attorney in the new name duly notarized and legalized up to the Consulate of Jordan.
2. Certificate of change of name duly legalized up to the Consulate of Jordan.

Change of address Application

1. Power of attorney in the new address duly legalized up the Jordanian Consulate

Recording License Agreement Application

1. Power of Attorney from the licensee duly notarized and legalized up to the Consulate of Jordan.
2. License agreement document, duly notarized and legalized up to the Consulate of Jordan.
3. Trademark registration number and class.

 

Jordan – Patents

 

Patent Protection Period: 20 years

Annuity Payments: Required upon issuance of Letters Patent starting from the filing or priority date. Late settlement is possible within 6 months as of the annual due date, and fees in this case are doubled.

From Filing to Grant: 2 years average

Convention Priority: Yes

Novelty: Required. The disclosure of the invention to the public shall not be taken into account if it occurred twelve months before the filing date of the application or before its priority date.


Filing Language: Specifications, claims, abstract, drawings and related documents should be translated into Arabic if they are in English and into English and Arabic if they are in a third language.

Procedure: Once the patent application is filed, it is queued to be examined by Jordanian Patent Office with respect to compliance with formalities. If accepted, the applicant is notified to settle the substantive examination fees. Upon settlement, the application is forwarded to substantive examination. The examiner may request amendments to the application. When the application meets all requirements stipulated in the Law and the terms of granting the patent, and upon settlement the publication fees, a decision of preliminary acceptance is issued and published in the Official Gazette. In absence of any opposition within 3 months as of the publication date, the Registrar shall issue his decision granting the patent after the payment of the due fees.

Filing Requirements for Patent Application:

1. Powers of Attorney duly legalized up to the Jordanian consulate.
2. Patent application form No. 4 sworn and signed by the inventor(s) as applicant(s) or jointly with applicant(s), duly legalized as above.
3. Certified copies of priority documents, if priority is to be claimed.
4. Certified Copy of certificate of incorporation of the applicant company.
5. Copies of the specification abstract and claim.
6. 1 copy of the specifications in English, with Arabic translation.
7. 1 set of formal drawings.
8. An abstract containing a summary of the main points of the patent specifications and claims;

Assignment Applications

1- Power of Attorney by the Assignee, duly legalized up to the Consulate of Jordan
2- Deed of Assignment, signed by both parties, notarized and legalized up to the Consulate Jordan.
3- Name, address, nationality and profession or nature of business of the Assignee

Change of Name/Address Applications:

1- Power of Attorney in the new name/address duly legalized up to the Consulate of Jordan.
2- Certificate proving the change of name/address, duly legalized up to the Consulate of Jordan.

License/Registered User Agreements Applications:

1. Power of attorney, duly legalized up the Consulate of Jordan
2. License Agreement executed by both parties, duly legalized up to the Consulate of Jordan.

 

Jordan – Designs

 

Design Protection Period: 15 years from filing date.
From Filing to Grant: 18 Months average
Convention Priority: Yes
Novelty: Absolute
Annuity: Not applicable.

Procedure: Once the Design application is filed, it is queued to be examined with respect to compliance with the Patent Office requirements. Upon acceptance, the application will be published in the Official Gazette. There is 3 months period for any interested party's opposition. In absence of any opposition, the certificate of registration is issued.

Filing Requirements for Design Application:

1- A Power of Attorney notarized and legalized up to the Jordanian Consulate, signed by the applicant.
2- A copy of the certified copy of the certificate of registration of the company or the articles of association. (Legalization is not required).
3- A deed of assignment notarized by the notary public and legalized up to the Jordanian Consulate, noting that this form must be jointly signed by the applicant(s) and the designer(s).
4- A certified copy of the priority document, if priority is to be claimed.
5- An abstract showing the elements of novelty of the subject design application. Noting that any application does not contain the same will be considered as rejected. It is important to take note that the novelty elements should only refer to the outside shape features, ignoring any technical or use features.
6- Multi side views of the subject design.

Assignment Application

1- A Power of Attorney signed by the assignee, notarized and legalized up to the Jordanian Consulate.
2- An assignment deed signed by the assignor and the assignee, notarized and legalized up to the Jordanian Consulate.
3- Name, address, nationality and profession or nature of business of the assignee.

License Application

1. A Power of Attorney notarized and legalized up to the Jordanian Consulate.
2. License agreement document notarized and legalized up to Jordanian Consulate.
3. Design registration number.

Merger Application

1- A Power of Attorney notarized and legalized up to the Jordanian Consulate.
2- Merger document notarized and legalized up to Jordanian Consulate.

Change of Name Application

1- A Power of Attorney notarized and legalized up to the Jordanian Consulate in the new name.
2- A certified and legalized copy of the change of name certificate issued by the home registry.

Change of Address Application

1- A Power of Attorney notarized and legalized up to the Jordanian Consulate.
